  • “Services” refers to property management, estate agency, consultancy, property listings, and any other services offered by Eteneva Properties Limited.

2. Scope of Services

Eteneva Properties Limited provides, among others:

  • Property management services for residential, commercial, and industrial properties.

  • Estate agency services including tenant screening, letting, sales, and marketing in compliance with the Estate Agents Act Cap 533.

  • Consultancy services including financial advice, rental assessments, market surveys, and client linkage to financial institutions.

  • Marketing and listing of properties for rent, lease, or sale.

3. Use of Website and Services

  1. You must be at least 18 years of age to use our services.

  2. You agree to provide accurate, current, and complete information when engaging our services or making inquiries.

  3. You shall not misuse our website or services for unlawful, fraudulent, or misleading purposes.

  4. Unauthorized attempts to breach website security, manipulate listings, or misuse client data are strictly prohibited.

4. Property Listings and Information Accuracy

  1. We strive to ensure that property descriptions, prices, availability, and related information are accurate.

  2. Information provided is for general guidance only and may change without prior notice.

  3. Clients and interested parties are responsible for conducting their own due diligence, including legal and financial checks, before making decisions.

  4. Eteneva Properties Limited shall not be liable for discrepancies, errors, or omissions in property details.

5. Tenant and Landlord Obligations

a) Tenants

  • Must honor tenancy agreements, pay rent on time, and adhere to occupancy policies.

  • Are responsible for day-to-day upkeep of the property.

  • Must report repair or maintenance issues promptly.

b) Landlords

  • Must provide properties that meet habitable standards and comply with statutory requirements.

  • Are responsible for major repairs, insurance, and statutory obligations unless otherwise agreed.

  • Must allow Eteneva Properties to manage tenant relations and rental collection where a management contract exists.

6. Fees and Payments

  1. Agency fees, management fees, commissions, and consultancy charges shall be agreed in writing prior to service delivery.

  2. All fees are payable in accordance with the agreed terms and timelines.

  3. Late payments may attract penalties or interest charges as stipulated in service agreements.

  4. Eteneva Properties Limited reserves the right to suspend services for non-payment.

7. Financial and Advisory Services

  1. We may link clients to financial institutions for loans, mortgages, or investment support.

  2. Eteneva Properties Limited is not a bank or financial institution and does not provide direct financing.

  3. We shall not be liable for decisions, approvals, rejections, or terms imposed by financial institutions.

8. Repairs and Maintenance

  1. We will facilitate communication between landlords and tenants regarding repairs.

  2. Landlords remain responsible for major repairs unless otherwise specified in contracts.

  3. Tenants may be held liable for damages caused through negligence or misuse.

9. Legal Compliance

  1. All property transactions shall be subject to Kenyan law, including but not limited to the Estate Agents Act Cap 533, Land Act, Landlord and Tenant Act, and related legislation.

  2. Clients must comply with all applicable laws, regulations, and tenancy agreements.

10. Limitation of Liability

  1. Eteneva Properties Limited shall not be liable for any indirect, incidental, or consequential damages arising from property transactions, website use, or reliance on information provided.

  2. We shall not be responsible for disputes between landlords and tenants outside our management scope.

  3. We shall not be liable for losses resulting from third-party service providers, financial institutions, or legal representatives.

11. Confidentiality and Data Protection

  1. We value your privacy and handle client information in accordance with applicable data protection laws.

  2. Personal and property-related information will not be disclosed to third parties without consent, except where required by law or in performance of contractual duties.

  3. By using our website and services, you consent to our data collection and usage practices as outlined in our Privacy Policy.

12. Termination of Services

  1. Either party may terminate service agreements by giving written notice as per the terms of engagement.

  2. Outstanding fees and obligations shall remain payable upon termination.

  3. Eteneva Properties Limited reserves the right to withdraw services for breach of contract, illegal activity, or misuse of services.

13. Intellectual Property

  1. All content on our website, including logos, text, images, and property listings, is owned by or licensed to Eteneva Properties Limited.

  2. Unauthorized reproduction, distribution, or use of our content is prohibited without prior written consent.

14. Amendments to Terms
